Acceptance of these terms.

These Terms & Conditions (“Terms”) govern your use of the Finally Mine Coffee House website (finallyminecoffee.com.au), any related subdomain, and the ordering, gift voucher, booking and careers services we provide through it (together, the “Service”).

By using the Service, placing an order, or purchasing a gift voucher, you agree to be bound by these Terms, our Privacy Policy, and our Refund & Cancellation Policy. If you do not agree, please do not use the Service.

About us.

References in these Terms to “we”, “us”, or “our” are to Eustress Coffee Pty Ltd (ABN 50 677 479 622), trading as Finally Mine Coffee House. References to “you” or “your” are to the customer using the Service.

Who can use the service.

To use the Service, you must:

• Be at least 13 years old (or have parental consent if aged 13–17);
• Be at least 18 years old to order alcohol;
• Provide accurate and complete information when placing an order;
• Have legal capacity to enter into a binding contract;
• Not use the Service for any illegal, harmful or fraudulent purpose.

Placing an order.

When you place an order through our Service, you are making an offer to purchase the selected items at the displayed price. Your order is accepted when:

• Payment is successfully captured by our payment processor (Square); and
• You receive an order confirmation email from us.

We reserve the right to refuse or cancel any order at our discretion, including (but not limited to) where the item is no longer available, where pricing was displayed in error, where we suspect fraud, where we cannot verify your age for alcohol orders, or where completion of the order would breach the law. If we cancel your order after payment, we will refund the full amount.

Pricing, GST & payment.

All prices shown on the Service are in Australian Dollars (AUD) and inclusive of Goods and Services Tax (GST) where applicable.

Payment is processed through Square, Inc. Finally Mine does not store your full payment card details. A tax invoice will be issued by email following successful payment.

We make reasonable efforts to ensure prices are accurate. If a pricing error is identified before fulfilment, we will contact you to confirm the correct price or cancel the order and refund any payment received.

Availability & right to refuse.

Menu items and their availability may change without notice due to seasonal sourcing, supplier availability, kitchen capacity, or operational decisions. If an item you have ordered becomes unavailable after payment, we will contact you and offer:

• A substitute item of equivalent value; or
• A full refund for that item.

We may refuse to serve any person at our sole discretion, in accordance with the law. Staff may refuse to serve alcohol where they are not satisfied as to your age, where you are intoxicated, or where they reasonably believe service would breach the Liquor Control Reform Act 1998 (Vic).

Pickup & fulfilment.

All online orders are available for pickup or dine-in at 14 Breed Street, Traralgon, Victoria 3844. We do not currently offer delivery.

Your estimated pickup time is shown at checkout and is an estimate only, actual timing may vary depending on venue load. Your order will be prepared to order; food quality cannot be guaranteed if collected significantly later than the selected pickup time.

You must collect your order during our trading hours:

• Cafe: 5:30 AM – 3:00 PM, seven days
• Bar: Thursday, Friday, Saturday, 5:00 PM – late

Cancellations, changes & no-shows.

Full details are in our Refund & Cancellation Policy. In summary:

• Within 5 minutes of ordering, free cancellation, full refund, provided preparation has not started.
• After preparation has started, no refund, but we will do our best to offer a substitute or store credit at our discretion.
• No-shows, if you do not collect your order within 60 minutes of the scheduled pickup time and we cannot reach you, the order may be disposed of and no refund will be issued.

Alcohol, 18+ only.

Finally Mine Coffee House holds a liquor licence under the Liquor Control Reform Act 1998 (Vic). By ordering any alcoholic item you warrant that:

• You are 18 years of age or older;
• You will present valid government-issued photo identification (Australian driver licence, Australian passport, Keypass, or Victorian Proof of Age card) at pickup;
• You will not supply alcohol to a minor;
• You are not intoxicated at the time of collection.

Staff are required to refuse service where any of the above cannot be confirmed. No refund will be issued for alcohol orders refused at pickup due to failure to provide identification, intoxication, or suspicion of supply to a minor.

Gift vouchers.

Gift vouchers issued by Finally Mine are governed by the Australian Consumer Law and Victorian consumer protections. Our voucher terms:

• Vouchers are valid for no less than 3 years from the date of issue, as required by Australian law;
• Vouchers are redeemable in-store at 14 Breed Street, Traralgon for any menu item to the value of the voucher;
• Vouchers are not redeemable for cash and no change is given if the purchase is less than the voucher value;
• Unused balances remain on the voucher for future use;
• Lost or stolen vouchers cannot be replaced unless the original digital receipt and unique voucher code can be produced;
• Vouchers cannot be used to purchase further gift vouchers.

Intellectual property.

All content on the Service, including the Finally Mine name, logo, wordmark, photography, menu descriptions, recipes, blog articles, video, and website design, is owned by Finally Mine Coffee House or our licensors, and is protected by Australian and international copyright and trade mark laws.

You may view, share and quote reasonable portions of our content for personal, non-commercial use with attribution. You may not reproduce, redistribute, modify, or use our content for commercial purposes without our prior written consent.

Your conduct.

You agree not to:

• Use the Service to engage in fraudulent, deceptive or illegal activity;
• Interfere with or disrupt the operation, security or integrity of the Service;
• Scrape, harvest, or re-publish our content without consent;
• Impersonate another person, misrepresent your age, or use false payment information;
• Harass, abuse or threaten our staff, either in-store, by phone, by email, or on social media;
• Use the Service in any way that could damage, disable, overburden, or impair our systems.

Australian Consumer Law.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms limits or excludes any right, guarantee, or remedy you have under the Australian Consumer Law.

For major failures in the goods supplied by us, you are entitled to a refund, replacement, or repair at your choice. For minor failures, you are entitled to have the issue remedied in a reasonable time. You are also entitled to compensation for any other reasonably foreseeable loss or damage.

Limitation of liability.

To the maximum extent permitted by law, and subject to our obligations under the Australian Consumer Law:

• Our total aggregate liability to you for any claim arising out of or in connection with the Service or your order is limited to the amount you paid to us for the relevant order;
• We are not liable for any indirect, consequential, incidental, or special loss, including loss of profits, loss of data, or loss of opportunity;
• We are not liable for any loss or damage caused by circumstances outside our reasonable control (see the Force Majeure section).

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Indemnity.

You agree to indemnify and hold harmless Finally Mine Coffee House, its directors, employees, contractors and agents from any loss, cost, claim or damage arising from your breach of these Terms, your misuse of the Service, or your unlawful conduct.

Termination.

We may suspend or terminate your access to the Service at any time, without notice, if we reasonably believe you have breached these Terms or engaged in conduct that is fraudulent, abusive, or harmful to our staff, other customers, or the business.

Force majeure.

We are not liable for any delay or failure to perform our obligations under these Terms where that delay or failure is caused by events outside our reasonable control, including (without limitation) natural disasters, fires, floods, strikes, power outages, supplier failures, pandemics, governmental orders, or internet, payment or cloud-services outages.

Governing law & jurisdiction.

These Terms are governed by the laws of the State of Victoria, Australia. You and Finally Mine each submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia in respect of any dispute arising out of or in connection with these Terms or the Service.

Changes to these terms.

We may update these Terms from time to time. The “Effective” date at the top of the page reflects the most recent version. Continued use of the Service after changes constitutes acceptance of the updated Terms.

For material changes, we will notify customers on our mailing list by email at least 14 days before the change takes effect.
